N-HYPPADEC FREEDOM OF INFORMATION COMPLIANCE STATEMENT
The Freedom of Information Act, 2011 (“FoI”) is an Act enacted by the National Assembly with the overall aim of improving public access to information. The FoI seeks to amongst other issues, to make public records and information more freely available; ease public access to public records and information; protect public records and information to the extent consistent with public interest and the protection of personal privacy; protect serving public officers from adverse consequences of the disclosure of certain kinds of information without authorization and establishes procedures for the achievement of the stated aims, and related matters.

NATIONAL HYDROELECTRIC POWER PRODUCING AREA DEVELOPMENT COMMISSION
The N-HYPPADEC Act refers to the legislative framework establishing and governing the National Hydroelectric Power Producing Areas Development Commission (N-HYPPADEC) in Nigeria. Originally established by the HYPPADEC (Establishment) Act of 2010, its mandate and name were significantly expanded under the Electricity Act 2023.
Key Provisions & Mandate

Purpose: To manage ecological challenges (such as flooding and erosion) and promote socioeconomic development in communities hosting major hydroelectric dams.

Funding: The Electricity Act 2023 mandates that 10% of the total revenue generated by any company operating hydroelectric dams in member states be paid to the Commission to fund host community development.

Member States: The Commission currently operates across 10 states:

Niger, Kogi, Kwara, Kebbi, Plateau, and Benue (Original members).

Kaduna, Nasarawa, Taraba, and Gombe (Added under the 2023 Act).

Governance Structure

Leadership: The Commission is led by a Managing Director and a Governing Council appointed by the President.

Rotational Chairmanship: The office of the Chairman rotates among member states in alphabetical order.

Eligibility Rules: Per Section 12 of the original Act (and reinforced in subsequent updates), the Managing Director must be an indigene of one of the member states.

Flood Control: Construction of drainage systems, flood walls, and desilting water channels.

Resettlement: Implementation of housing schemes for communities frequently submerged by dam operations.

Empowerment: Providing vocational training for youth and distributing agricultural tools (like power tillers and subsidized fertilizer) to local farmers.

Infrastructure: Construction of solar-powered boreholes and streetlights in rural riverine areas.

Right of Access to Information
N-HYPPADEC ensures that qualifying information is freely disclosed on the Commission’s website, Annual Reports and through print and digital media to stakeholders.
Accordingly, N-HYPPADEC is committed to:

– Providing public access, to qualifying records and information.
– Protecting public records and information to the extent consistent with the public interest and the protection of personal privacy.
Any person may request or access qualifying information from N-HYPPADEC.
Designation of a Freedom of Information Officer.
In compliance with Section 2 of the Fol and related guidance, N-HYPPADEC has established an FOI Desk through which its Fol obligations are managed. N-HYPPADEC has also designated an Fol Officer to man the Fol Desk.

The N-HYPPADEC Fol Desk is mandated to:
– Ensure the proactive disclosure of relevant information, periodically.
– Review Fol applications for access to information and records.
– Ensure that applications are brought to the notice of appropriate Departments, or Units within N-HYPPADEC as soon as requests are received.
– Liaise with other Departments, to address requests.
– Consult, where necessary, with other stakeholders in and outside N-HYPPADEC on FOI-related matters.
– Ensure the appropriate and timely response to all Fol requests.
– Record all FOI requests and the actions taken.
– Prepare and submit the Annual Fol Report to the Office of the Attorney-General of the Federation.
– Ensure that N-HYPPADEC’s Annual Fol Report is published and is easily accessible by the public.
